Terms of Service

1. Acceptance of Terms

By accessing and using AVIA's services, including dealer programs, installation services, and training, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Dealer Partnership Programs

AVIA offers comprehensive dealer partnership programs for automotive dealerships. Participation in these programs requires:

  • Completion and approval of dealer application
  • Agreement to program-specific terms and conditions
  • Adherence to FTC compliance requirements
  • Maintenance of service quality standards
  • Proper use of AVIA branding and materials

3. Service Offerings

AVIA provides the following service divisions:

  • Addendum Design Services (FTC-compliant dealer addendum creation)
  • Installation Services (door guards, window tinting, PPF, ceramic coating)
  • Training Services (sales training and technical support)

Service availability, specifications, and delivery timelines are subject to change. AVIA reserves the right to modify or discontinue services at any time.

4. Warranties and Limitations

AVIA provides warranties for services rendered as outlined in specific service agreements. All services are provided "as is" without additional warranties beyond those explicitly stated in writing.

AVIA is not liable for indirect, incidental, special, or consequential damages arising from the use of our services. Total liability is limited to the amount paid for the specific service in question.

5. Intellectual Property

All AVIA branding, designs, training materials, and proprietary processes remain the intellectual property of AVIA. Dealers are granted limited license to use AVIA materials solely for authorized business purposes during the term of the partnership.

Unauthorized reproduction, distribution, or modification of AVIA materials is strictly prohibited.

6. FTC Compliance

AVIA is committed to FTC compliance in all dealer addendum design and services. Dealers are responsible for ensuring their use of AVIA services complies with all applicable federal, state, and local regulations.

7. Termination

Either party may terminate the dealer partnership agreement with written notice as specified in the partnership contract. Upon termination:

  • Dealer must cease use of AVIA branding and materials
  • Outstanding payments become immediately due
  • Confidentiality obligations remain in effect
  • Service commitments must be fulfilled or compensated

8. Confidentiality

Both parties agree to maintain confidentiality of proprietary information, including pricing structures, training materials, business processes, and customer information.

9. Modifications

AVIA reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active dealer partners. Continued use of services after modifications constitutes acceptance of updated terms.

10. Governing Law

These Terms of Service are governed by applicable state and federal laws. Any disputes will be resolved through binding arbitration in accordance with commercial arbitration rules.
